Parathas come in the category of luxury, 18 percent GST will have to be paid, Gujarat court’s decision

आगरालीक्स… आप पराठे खाते हैं तो यह लग्जरी की श्रेणी में आते हैं। इस पर18 प्रतिशत जीएसटी देना होगा। गुजरात जीएसटी प्राधिकरण ने यह फैसला दिया है। रोटी पर जानिये क्या कहा।

वाडीलाल इंडस्ट्रीज की अपील पर सुनवाई

याचिकाकर्ता वाडीलाल इंड्रस्ट्रीज की अपील पर गुजरात की अपीलेट अथॉरिटी ऑफ एडवांस रूलिंग का रेडी टू कुक पराठों पर यह फैसला आया है। अपीलकर्ता का कहना था कि उनकी कंपनी आठ तरह के फ्रोजन पराठे बनाती है, जिसमें आलू पराठा, लच्छा पराठा, मलवार पराठा, मिक्स पराठा, प्लेन पराठा आदि शामिल हैं।

दलील- पराठे में होता है आटे, सब्जी का इस्तेमाल

इसमें मुख्य रूप से आटे का इस्तेमाल होता है। यह रोटी की श्रेणी में आता है और इसमें मुख्य रूप से तेल, सब्जी का इस्तेमाल किया जाता है,जिसे लोग घर पर ले जाकर गर्म कर खा सकें। इसलिए इन पर एसजीएसटी या सीजीएसटी नहीं लगना चाहिए।

पराठा में घी-बटर लग्जरी, रोटी रेडी टू ईट

इस पर गुजरात की अपीलेट अथॉरिटी ऑफ एडवांस रूलिंग ने कहा कि रोटी रेडी टू ईट होती है, जबकि पराठा फ्रोजोन रेडी टू कुक है। पराठा और रोटी एकदम अलग है। आप रोटी बिना घी-बटर के खा सकते हैं, जबकि पराठा आप बिना घी और बटर के नहीं खा सकते। चूंकी घी और बटर लग्जरी की श्रेणी में आता है।

रोटी पर पांच प्रतिशत ही रहेगा जीएसटी

इसलिए इस पर 18 प्रतिशत जीएसटी वसूला जाना चाहिये। वहीं रोटी पर पांच प्रतिशत ही जीएसटी लगेगा।
