SP leader complaint for objectionable social media post in Agra

आगरालीक्स …आगरा में सोशल मीडिया पर सपा सुप्रीमो मुलयाम सिंह, सीएम अखिलेश यादव और बसपा सुप्रीमा मायावती के लिए सोशल साइट पर अपशब्द लिखने पर तहरीर दी गई है। अपनी वॉल पर पोस्ट करने के मामले में एसपी ग्रामीण बबिता साहू को तहरीर देते हुए मुकदमा दर्ज करने की मांग की गई है।
एक युवक का दोस्त सपाई हो गया है, इससे वह आक्रोशित है और उसने अपने आक्रोश को व्यक्त करने के लिए सोशल मीडिया का इस्तेमाल किया। अपने दोस्त के सपाई होने पर उसने अपनी फेसबुक वॉल पर दोस्त के साथ ही सपा सुप्रीमो मुलयाम सिंह, सीएम अखिलेश यादव और बसपा सुप्रीमा मायावती को अपशब्द लिखे हैं। इस मामले में सपा कार्यकर्ताओं ने एसपी ग्रामीण को तहरीर देते हुए मुकदमा दर्ज करने की मांग की है। इस मामले में सेक्शन 66 एक के तहत कार्रवाई हो सकती है।

section 66 A
“Any person who sends, by means of a computer resource or a communication device

(a) any information that is grossly offensive or has menacing character; or

(b) any information which he knows to be false, but for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred or ill will, persistently by making use of such computer resource or a communication device,

(c) any electronic mail or electronic mail message for the purpose of causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the origin of such messages, shall be punishable with imprisonment for a term which may extend to three years and with fine.”

Section 66A provides punishment for sending offensive messages through communication services.

• Any other electronic record which may be transmitted with the message

The law targets messages that…

• Are grossly offensive or menacing

• Proffer false information intending to cause annoyance, inconvenience, intimidation, insult, obstruction, etc.,

• Are intended at deceiving the addressee about the origin of the message

The law was amended in 2008 and received Presidential assent on February 5, 2009.
