दिल्ली निवासी याचिकाकर्ता श्रेया सिंघल ( 25 साल) ब्रिस्टोल यूनिवर्सिटी, यूके से एस्ट्रो फिजिक्स में तीन वर्षीय कोर्स पूरा करने के बाद वर्ष 2012 में दिल्ली वापस आ गई। वे लाॅ स्कूल ज्वाइन करना चाहती थी।
उनके दिल्ली आने के बाद पोंडुचेरी में एक बिजनेसमैन ने सोशल मीडिया पर तत्कालीन वित्त मंत्री पी चिदंबरम के बेटे कृति पर टिप्पणी की थी। उन्हें गिरफ्तार कर लिया गया इसके कुछ दिन बाद ही मुंबई में शिवसेना प्रमुख बाल ठाकरे की मौत के बाद उनके अंतिम संस्कार के समय तीन घंटे के लिए बिजली आपूर्ति ठप कर दी गई थी। इस पर मुंबई की दो युवतियों ने सोशल मीडिया पर टिप्पणी की, उन्हें भी गिरफ्तार कर लिया गया था।
लोगों के भाषण और अभिव्यक्ति की स्वतंत्रता के अधिकार को कायम रखने के लिए श्रेया सिंघल ने 30 नवंबर 2012 को आईटी एक्ट की धारा 66 ए को अंसवैधानिक बताते हुए सुप्रीम कोर्ट में याचिका दायर की थी।

“A law has to be for the people. It’s a big victory for free speech in the country,” Shreya Singhal, the original petitioner in the case, said.

She said that none of the persons who had been arrested in the case had disrupted law and order.

“I am very happy with this verdict…We have fought for three years and are very happy,” she said.

“No one should be afraid of putting something up due to fear of prison,” Singhal said.

फेसबुक, ट्विटर, लिंकड इन, व्हाट्स एप सरीखे सोशल मीडिया माध्यमों पर कोई भी पोस्ट डालने पर किसी की गिरफ्तारी नहीं होगी, इससे पहले धारा 66A के तहत पुलिस को ये अधिकार था कि वो इंटरनेट पर लिखी गई बात के आधार पर किसी को गिरफ्तार कर सकती थी। सुप्रीम कोर्ट में दायर याचिकाओं में आईटी एक्ट की धारा 66A को चुनौती दी गई थी।
